QUANTUM MERUIT (See also:Lat. for " as much as he has de-served ") , in the See also:law of See also:contract, originally a See also:form of See also:action on the See also:case, grounded on a promise to pay the See also:plaintiff for See also:work done as much as it was See also:worth . It has been abolished as a See also:special form of action, but the See also:term is still in use where, in cases of special contract, there has been a See also:breach amounting to a See also:discharge by one party before the other party has done all that he was See also:bound to do . In such a case the plaintiff sues for a quantum meruit or the value of so much as he has done . |
